Many have been watching Commonwealth vs Lindsay Clancy on YouTube and marveling at her attorney’s, Kevin Reddington, compelling cross-examination of the prosecutor’s expert witnesses. I would suggest that there is another factor related to Mr. Reddington’s cross-examination. That is, the obvious ineffective, or lack of, pre-trial preparation of those experts by the prosecutors.

Did any of the attorneys from the prosecutor’s office actually meet with their experts prior to trial? If so, what did they talk about? Obviously, not much.

Remember, your client relies on you to decide if an expert is necessary in their case and if so, which expert to hire. Also, those experts are paid a handsome amount of money. Therefore, days before deposition and/or trial, you need to prepare your expert for his or her testimony.

Reserve time with your expert, where you will not be disturbed. Give to your expert all relevant documents which have been disclosed. Find and go over testimony of your expert from previous matters. Spend your time effectively discussing not only his or her testimony on direct examination, but also what you anticipate will be your opponent’s cross-examination.

Control your expert, do not let your expert control you.
